GENERAL TERMS FOR THE SALE AND USE OF PASSES - CLAUSES RELATING TO USE OF LIFTS
THE LIFT PASS
The lift pass is composed of a card on which transport entitlement details are recorded.
This card is a hand-free smartcard.
The purchase of a lift pass implies that the holder knows and accepts all of the current general terms of sale and use, without prejudice to their normal rights and means of redress.
The public price for the sale of lift passes and transport entitlement are displayed at the lift cashier desks.
Prices are given in euros (€) and include all applicable taxes.
Various categories of people can benefit from reduced or free passes in accordance with the conditions available at sales outlets, and on presenting any requisite supporting documentation at the moment of purchase. Photocopies of supporting documentation will not be accepted.
No partial or total refund will be granted after the moment of purchase.
THE HANDS-FREE CARD
The lift pass is recorded on a hands-free card that is available for €1.
This card must not be bent, broken, pierced, or rendered unusable in any other way.
For technical reasons the company reserves the right to end the use of hand-free cards, in which case clients will be notified of the details and timeframe of withdrawal by information posted at the cashier desks.
The cards are rechargeable and may be used one or more times within the guaranteed 2-year lifespan.
The guarantee only applies in the case of normal usage of the card, and consists in replacing any defective card with a new one.
VALIDITY AND LIMITATIONS PERTAINING TO THE LIFT PASS
Lift passes are personal and non-transferable.
Lift passes for a period greater than 3 days are only valid when accompanied by a recent ID photo.
The lift pass must be presented for all inspections and the user be able to prove their identity.
Whilst valid it entitles the user to circulate freely on the lifts in service corresponding to the entitlement category (date, domain, age category, etc).
The user must have the lift pass in his or her possession throughout the journey from the departure area to the arrival area of the lift.
Transport entitlements sold during the winter are no longer valid after the lift closure date for the current winter.
Transport entitlements sold during the summer are no longer valid after the lift closure date for the current summer.
PROOF OF PURCHASE
Proof of purchase is issued with every lift pass. This document must be kept and presented in the event of any request/complaint.
PARTIAL OPENING OF THE DOMAIN
No compensation will be made in the event of the domain being partially opened due to weather conditions, safety conditions, or technical considerations.
Partially used and unused lift passes. Transport entitlements that have been issued but have not been used or else only partially used cannot be refunded or exchanged.
Lift passes for non-consecutive days must be used within the current season, after which they cannot be used, nor will they be reimbursed or their validity extended in any way.
Payment is in euros, and may be made in cash, by bank card, holiday voucher, or cheque made out to the company and drawn on a French bank account. A receipt or other proof of purchase is issued on request.
LIFT PASS INSPECTION
Any person using a lift providing access to the domain covered by these conditions and not in possession of a lift pass, or with a non-valid lift pass in their possession (with invalid dates or domain, etc), or with a non-compliant or falsified pass, will be liable to prosecution and/or a fine as set out below.
Agents working for the lift company will carry out inspections and any infraction, depending upon its nature, will give rise to:
- Payment of a fixed fine, in which case prosecution will not ensue.
This fixed fine will not exceed FIVE times the cost of a daily lift pass for the lift network in question ((Articles L 342-15, R 342-19 and R 342-20 of the French Tourism Code)
- Legal action
- In addition to the fixed fine and legal action mentioned above, agents working for the lift company will immediately withdraw any lift pass not corresponding to its bearer.
INFRACTIONS TO TRANSPORT CLAUSES
In the event of failure to comply with police regulations or the current general conditions of sale and use, lift passes may be withdrawn and retained as proof. Depending upon how serious the infraction is, it may give rise to the payment of a fixed fine plus any additional processing costs, or to legal proceedings, as well as to the payment of damages.
LOSS, THEFT, AND FORGOTTEN OR DAMAGED PASSES
Any lost lift passes that have been found are kept at RASL Les Angles (RASL Les Angles: +33 (0)4.68.04.42.18).
Passes which have not been found, or which have been stolen, forgotten, or damaged, will not be replaced or refunded. Les Angles winter season lift passes, and lift passes for stays of greater than 3 days, that have not been found, or have been stolen or damaged, will not be refunded. They can be replaced on presentation of duplicates issued at the cashier desks or on presentation of the appropriate proof of purchase. The user will contribute 50% of the cost of the remaining valid days on the lift pass, and purchase a new hands-free card at a cost of €1.
Last or stolen lift passes will be rendered unusable on the hands-free system.
PROCEDURES FOR FIXED-RATE DAMAGES IN THE EVENT OF SERVICE INTERRUPTION
In the event of interruption of lift service, holders of a 6-day lift pass may be offered ‘compensation’ in the event of all lifts being completely shut down for a consecutive period of more than half a day. This compensation will be calculated at the end of the 6-day period and will be equal to the difference between the price paid by the client and the days actually used.
On producing the necessary documentation the client will receive either
- an immediate prolongation of their lift pass
- or a credit note for a certain number of day(s).
Reduced prices are available for families, for children under the age of 5, children under the age of 12, and seniors over the age of 70, on presentation of proof of age at the moment of purchase.
Except in the event of a breach of service of the sort referred to in the paragraph ‘Procedures for fixed-rate damages in the event of service interruption’, and apart from under the specific conditions relating to the cancelling of orders placed by mail or Internet, no lift pass will be refunded except in the event of force majeure (the absence of snow does not constitute a case of force majeure).
No lift pass will be refunded in the event of accident, illness, or any other personal cause, and this irrespective of the length of validity of the lift pass. Insurance may be taken out against this risk and you can obtain further information about this from our sales assistants.
PERSONAL DATA PROTECTION
All information requested by the company must be provided for a lift pass to be issued. If any obligatory information is missing the lift pass will not be issued.
This data is collected for management purposes, the inspection of transport entitlements, and statistics.
For personal entitlements data is also gathered about the movement of their bearers in order to manage lift access and carry out inspections. Data is also gathered for statistical purposes.
In accordance with the French Data Protection Act of 6 January 1978, modified by law number 78-17 of 6 August 2004, the bearer has the right to consult, correct, and delete any data for legitimate reasons by writing the company at the following address: RASL Les Angles – Gare des Télécabines – BP18 - 66 210 Les Angles – France
It is strongly recommended that users of the tracks and lifts on the domain familiarise themselves with the relevant bylaws.
APPLICABLE LAW AND DISPUTES
This contract is subject to French law. Before taking any case to court the parties are obliged to seek redress via a conciliation procedure. In the event of a legal dispute, only the courts of Perpignan are competent.

SPECIFIC CONDITIONS RELATING TO DISTANCE SELLING OF LIFT PASSES
The placing of an order implies the acceptance by the person (hereafter referred to as the ‘client’) of the specific conditions relating to distance selling.
Should an event occur not fully covered by these conditions, it will be governed by the rules in use by distance-selling companies headquartered in France.
These conditions complement the ‘General conditions of sale and use of lift passes’ on display at sales outlets, on the website, and/or appended to the order form.
The various lift passes on sale (such as geographical domain, period of validity, and so on) are presented in the price chart which may be consulted at sales outlets and/or on the above-mentioned website.
The contractual information is given in French.
These conditions relate exclusively to non-trading individuals.
ARTICLE 1: PLACING AN ORDER
The remote purchase of a lift pass is conducted by placing an order online at the following address: www.lesangles.com.
For online sales:
The order can only be registered and processed on the website if the client has clearly identified his or her self.
- Either by entering their strictly personal access code (login plus password).
- Or by filling out the online form enabling them to obtain their access code.
In order to finalise an order the client must accept the current conditions as well as the general conditions of sale and use of lift passes
In accordance with the provisions of article 1369-5 of the French Civil Code, the client has the opportunity to check the details of the order and the total price and correct any errors there may be, before confirming the order and thereby expressing their acceptance of the contract. RASL Les Angles will confirm the order by an email sent to the client.
Except for online recharging as set out in article 2, complete online orders (including payment, photographs, and supporting documentation where applicable) must be placed on the www.lesangles.com website at least 7 days before the first day of validity of the lift pass.
By placing an order the customer accepts the prices and the description of services.
ARTICLE 2: ONLINE RECHARGING OF LIFT PASS
It is possible to recharge the transport entitlement on the Les Angles lift pass, in accordance with the products available on the RASL Les Angles website at www.lesangles.com
Payment is by bank transfer.
RASL Les Angles sends a receipt of order to the client which they must keep, especially for inspections carried out on the lifts
The entitlement is automatically recharged the first time the client passes in front of a hand-free terminal.
ARTICLE 3: PRICES AND PAYMENT PROCEDURES
Prices are given inclusive of all taxes in euros, with VAT calculated at the rate applicable on the day of order.
If the order is sent out to the client, the cost of delivery will be €5 in France, and €8 for neighbouring countries in the euro zone.
Payment of the order is due immediately, to be made in euros by bank card or transfer.
Bank card transactions are carried out via a secure system (PAYBOX and SPPLUS) in collaboration with the Caisse d’Epargne, to guarantee the confidentiality of transactions. Payment is by a virtual electronic payment terminal and carried out immediately.
At no stage does RASL Les Angles have knowledge of the numbers supplied by the client. RASL Les Angles is only informed that the total due for the order has been transferred into its bank account.
ARTICLE 4: CONFIRMATION OF ORDER
Orders paid by bank card will be confirmed once the bank has issued its agreement.
Should the bank refuse to debit its client's account, the order will be cancelled and the client informed.
Once an order has been placed on the www.lesangles.com website and confirmed by the client then RASL Les Angles will send out an email to the client confirming the order.
ARTICLE 5: DELIVERY OF THE ORDER
The client can choose
Either to have the order delivered to an address provided for this purpose.
Except in the event of force majeure RASL Les Angles undertakes to deliver entitlements by mail at least 7 days before the first day of validity of the lift pass at the very latest. (Date as per postmark)
Or to collect the entitlements at a RASL Les Angles sales outlet of the client’s choice, during the opening hours of the sales outlet.
The client will need to produce the order confirmation as well as valid proof of identity.
Otherwise the ordered lift passes will not be delivered.
The order will be issued once the client has signed for it, and a receipt will be issued. (Except for online recharging).
ARTICLE 6: RIGHT OF WITHDRAWAL NOT APPLICABLE
In accordance with article L121-20-4 of the French Consumer Code the sale of transport entitlements is not subject to the right of withdrawal provided for in articles L121-20 et seq. of the Distance-selling Consumer Code.
ARTICLE 7: CANCELLATION AND CHANGES TO THE ORDER
Once the client has confirmed the order of the lift pass, it will not be refunded, taken back, or exchanged. Equally it is not possible to modify the order in any way
ARTICLE 8: RESPONSIBILITY AND GUARANTEES
The liability of RASL Les Angles only extends to providing the means for the various stages of online purchase.
RASL Les Angles shall not be held liable in any way for any inconvenience or damages arising from use of the Internet, including breach in service, outside intrusion, or the presence of a computer virus, or for any event deemed to fall under force majeure, as recognised by law.
The client declares that he or she is aware of characteristics and limitations of the Internet, specifically regarding its technical performance, the response time for consulting, examining, or transferring information, and the security risks.
ARTICLE 9: METHODS OF PROOF
The online provision of a bank card number and the final confirmation of the order by the client will constitute proof that the transaction is complete in accordance with the provisions set out in French Law number 2000-230 of 13 March 2000, and that payment is due.
This confirmation shall count as the equivalent of a signature and constitute express acceptance of all of the operations carried out on the online sales module.
The client must keep the order email as it is the only document which shall be accepted as legally binding in the event of a dispute over the terms of the order, and in particular during inspections on the lifts. Information about transport entitlement validity given on the smartcard has no contractual value.
ARTICLE 10: PROTECTION OF PERSONAL DATA
All the banking details provided by the client when placing an order are protected by a certified encryption method using high security encryption (RC4 128 bit), and SSL encryption for the bank card number.
The French Data Protection Authority (the CNIL) has been notified, in accordance with the law, of the processing of personal data resulting from sales on this website. Information provided by clients on the RASL Les Angles website is used to process and carry out the orders placed on the website.
In compliance with article 32 of the French Data Protection Law, RASL Les Angles notifies clients of the use made of this data, and in particular that it may be used for commercial offers.
ARTICLE 11: ARCHIVING
Orders are archived by the RASL Les Angles sales department in accordance with article L 134-2 of the French Consumer Code. Clients can thus consult their archived orders by writing to the sales department at the address given above.
